Terms of Service

You must be at least 18 years old to create an account. The Platform is intended for use by authorized club administrators, coaches, staff, parents, and guardians. Minor athletes do not hold their own accounts; information about a minor is managed by a parent, guardian, or an authorized club acting with parental authorization, as described in our Children's Privacy Notice.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at marketing@waresport.com if you suspect unauthorized use.

Waresport provides club management tools including registration, scheduling, payments, roster and staff management, communication, tryouts, facility booking, and related features.

When a club uses Waresport to manage information about its members, the club is the controller of that information and Waresport acts as a processor on the club's behalf, as set out in our Data Processing Agreement. Clubs are responsible for their own registration terms, fees, refund policies, safeguarding rules, and compliance with laws that apply to their programs.

You agree to use the Platform only for lawful purposes connected to sports operations and club management. You agree not to:

• upload or share content that is unlawful, harassing, defamatory, or infringes the rights of others;
• submit false, misleading, or inaccurate information;
• access or attempt to access data you are not authorized to view;
• interfere with, disrupt, probe, or attempt to gain unauthorized access to the Platform or its infrastructure;
• use the Platform to send unlawful, unsolicited, or unauthorized communications;
• reverse engineer, copy, modify, or create derivative works of the Platform except as permitted by law; or
• use the Platform to collect personal information about children except as authorized by a parent, guardian, or club and consistent with applicable law.

We may investigate suspected violations and suspend or restrict access where we reasonably believe these Terms have been breached.

The Platform sends operational messages such as schedule updates, reminders, receipts, and announcements through email, SMS, and WhatsApp, depending on the settings your club configures and the contact details provided.

By providing a phone number and opting in, you consent to receive automated and non-automated messages related to your club's activities from or on behalf of your club through Waresport. Message frequency varies. Message and data rates may apply. Consent to receive messages is not a condition of using the Platform where the messages are promotional in nature.

You can opt out of SMS messages at any time by replying STOP to any message, and you can reply HELP for assistance. You can opt out of email by using the unsubscribe link in any marketing message. WhatsApp and SMS delivery may be provided by third parties under their own terms. Opting out of operational messages may affect your ability to receive important club information.

Paid plans are billed on the cycle shown at signup (monthly or annually). Fees are described on our Pricing page and may change on notice for future billing periods. Unless stated otherwise, fees are exclusive of applicable taxes.

Payments are processed by our payment partner, Stripe. Registration and program fees that a club collects from its members are set and controlled by that club, and any related refunds are the club's responsibility, not Waresport's.

Any free trial, money-back guarantee, or migration offer applies as described at the time it is presented and is subject to its stated conditions.

The Platform, including its software, design, logos, and features, is owned by Waresport and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for its intended purpose during your subscription. You may not copy, modify, distribute, sell, or lease any part of the Platform without our written permission.

You and your club retain ownership of the data and content you upload. You grant Waresport a limited license to host, process, and transmit that content solely to provide and improve the Platform, consistent with our Privacy Policy and Data Processing Agreement. Clubs can export their data and request deletion as described in our Data Retention Policy.

The Platform integrates with third-party services such as Stripe, and clubs may enable additional integrations. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services we do not control.

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Waresport disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that it will meet your specific requirements.

Waresport is a tool to assist club operations. Decisions about games, scheduling, eligibility, safety, and club management rest with the club and its administrators.

To the fullest extent permitted by law, Waresport and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Platform, even if advised of the possibility of such damages.

To the fullest extent permitted by law, Waresport's total aggregate liability arising out of or related to these Terms or the Platform will not exceed the amount you paid to Waresport in the 12 months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless Waresport and its officers, employees, and agents from any claims, damages, liabilities, and reasonable legal costs arising out of your use of the Platform, your content, your violation of these Terms, or your violation of any law or the rights of a third party. Where you use Waresport on behalf of a club, this obligation applies to the club.

These Terms apply for as long as you use the Platform. You may stop using the Platform and close your account at any time. We may suspend or terminate access if you materially breach these Terms or use the Platform in a way that creates risk or legal exposure for Waresport or others.

On termination, your license to use the Platform ends. Clubs may request data export before closure. We will handle remaining data in accordance with our Data Retention Policy. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and indemnification, will survive.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules.

Any dispute arising under these Terms will be resolved in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and, where appropriate, notify you through the Platform or by email. Your continued use of the Platform after changes take effect means you accept the revised Terms.

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the documents they reference, are the entire agreement between you and Waresport regarding the Platform.
