As someone who runs a league, a travel baseball team, or a local weekend clinic, that waiver is the only thing separating your league from having a very uncomfortable conversation with your insurance adjuster. By 2026, you will be able to produce a waiver draft in less time than it would take you to tie your cleats. Let’s discuss how you can accomplish this task without the usual headache of legalese.

The “30 Second” AI Magic: Putting Together a Document

Let’s be honest – no one enjoys pulling together a legal document from scratch! In the past you had only two options: either hire someone for a minimum of $400/hour (to hear “heretofore”), or go out and find a 2004 template on a sketchy website.

According to the law, no one under the age of 12 can enter into contracts. A child who signs their name on the waiver is merely creating a piece of scribbled paper, not a legal contract. It’s important that there be a space on the waiver for a parent to sign as well. Digital signatures for waivers will be considered as valid as physical signatures as long as you can prove who the signer is, by the year 2026.

5. “Where? We Will Fight” (Governing Law)

You don’t want to have to travel across the country for a legal dispute. This section states that all legal disputes will occur in your own county/state; it saves you from a lot of stress in the future.

The “Negligence” Element: What Waivers Aren’t

The significant takeaway regarding waivers is that they are not an impenetrable barrier. 

A waiver will typically protect an organization from liability if the organization has engaged in ordinary negligence (e.g., the coach fails to confirm that the weather is appropriate for playing, and the team gets wet when they take the field in drizzle). However, if the organization is grossly negligent, i.e., allowing children to play on a field that has many open construction ditches and mud holes or letting the children play in a lightning storm, then the waiver may not protect the organization. 

As a general statement, a waiver only protects an entity from the risks associated with the game of football. The waiver does not protect an entity against its own recklessness. Therefore, if an organization is careful to keep children safe, they should not have any issues obtaining the benefit of a waiver.

The shift towards “Digital First” is a necessity

If you are using paper, you are taking a serious risk. Paper can be misplaced; ink can fade, and handwriting may become illegible.

As of 2026, electronic waivers will be the legal standard for youth sports for 3 reasons:

1. If one of your players is injured, you don’t want to be searching through stacks of cardboard boxes to locate their medical release form. You’ll want to simply type the child’s name into a search box to locate it in less than 2 seconds.

Separate The Photo Releases From The Liability Waiver. Do Not Hide The “Can We Post On Instagram?” Clause Within The Liability Waiver. It Should Be Clearly Labeled And Separate From The Release Of Liability Clause To Help Parents Feel Comfortable.

Annually Review The Waiver. Legal Trends Change Regularly, So Spend 10 Minutes In January On Each Waiver To Ensure It Accurately Reflects What You Are Doing.
